By accessing or using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. Exafol and/or its licensors own all intellectual property rights in the Services, including but not limited to the Exafol name, brand, artwork, design, interface elements, features, software, and documentation. You may not copy, modify, adapt, reproduce, distribute, or otherwise exploit any part of the Services without our prior written consent.
The Services may display trademarks, logos, and service marks ("Marks") owned by their respective brand owners or licensors. Exafol does not claim ownership of these Marks. You acknowledge and agree that Exafol may display and reuse your Marks for the purposes of product discovery, comparison, and helping users with their software research. Vendors shall not claim wrongful use against Exafol for such limited and fair use. Exafol specifically disclaims ownership of any software products listed on the Services; all rights and intellectual property remain with the respective vendor.
You agree not to use automated means to collect data, content, or information from the Services unless expressly permitted in writing by Exafol. Unauthorized use of our intellectual property or data may result in suspension of access, legal action, and claims for damages.
For any paid services offered by Exafol (such as advertisements or premium placements), you agree to make a one-time payment in accordance with the applicable pricing schedule.
Exafol uses third-party payment gateways to process transactions. You may be required to provide your payment information directly to these gateways. Exafol does not store your payment information and is not liable for any errors, delays, or issues arising from third-party payment gateways.
All payments made for Exafol services are non-refundable. There will be no refunds for partial services, unused services, or cancellations after payment has been processed.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, EXAFOL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE USE, AVAILABILITY, OR PERFORMANCE OF THE SERVICES. EXAFOL DOES NOT GUARANTEE THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, BE UNINTERRUPTED, OR BE FREE OF ERRORS OR DEFECTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXAFOL AND ITS AFFILIATES, OFFICERS, OR SPONSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICES IS TO DISCONTINUE YOUR USE.
The Services may contain links to third-party websites, materials, or content. Exafol does not monitor or review such third-party sites and is not responsible for their content, accuracy, legality, or practices. The inclusion of any link does not imply endorsement, approval, or affiliation by Exafol. Your access to and use of such linked websites is at your own risk.
Exafol reserves the right to modify these Terms or any related policies at any time. Updates will be effective immediately upon posting on the Services. You will be subject to the Terms in effect at the time of your use of the Services. If any provision of these Terms is found to be invalid, void, or unenforceable, that provision shall be deemed severable and will not affect the validity of the remaining provisions.
These Terms will remain in full force and effect while you use the Services. Exafol reserves the right, in its sole discretion, to suspend or terminate your account or access to the Services if you breach these Terms. Termination of your account does not limit Exafol's right to enforce any obligations or liabilities that accrued prior to termination.
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
